Terms of Service

1. Acceptance of Terms

This service is operated by AshWeb Inc. (the "Operator" or "we"). By accessing or using AI Influencer Studio ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

The AshWeb Platform Terms (/platform-terms) also apply to your use of this app. They cover AI-generated content, sharing characters with other users and apps, and reporting content; where they conflict with these Terms, the Platform Terms prevail.

2. Service Description

AI Influencer Studio provides AI-powered virtual influencer creation and management tools, including:

  • Character generation and customization
  • Consistent appearance across multiple images
  • Various style options and settings
  • Export capabilities for social media use

3. User Accounts

3.1 Account Creation

  • You must be at least 13 years old, or older if the law where you live requires it, to use this Service. If you are under 18, you cannot share characters with other users or earn from them.
  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • One person or entity per account unless otherwise agreed

3.2 Account Responsibilities

  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized use
  • We reserve the right to terminate accounts that violate these terms

4. Usage Limits and Fair Use

4.1 Credits

  • AI features use credits from your subscription or from a credit pack
  • Each plan and credit pack describes what it includes before you buy
  • Settings → Usage shows how much of your allowance is left

4.2 Fair Use Policy

  • No automated or bot usage without prior approval
  • No attempts to reverse-engineer or extract training data
  • Users are solely responsible for compliance with all applicable laws

5. Content Ownership and Licensing

5.1 Generated Content

  • You retain all rights to the virtual influencers you create
  • Generated images are yours to use commercially or personally
  • You grant us a limited license to display your content for service operation

5.2 User Content Responsibility

You are solely responsible for all content you generate, including but not limited to:

  • Ensuring compliance with all applicable laws and regulations
  • Respecting intellectual property rights
  • Managing any adult, sensitive, or controversial content
  • Avoiding impersonation of real individuals without proper consent
  • Taking responsibility for any content that may be considered offensive or inappropriate

We may review, restrict, or remove content and characters that break these Terms or the Platform Terms, and act on reports.

6. Payment and Billing

6.1 Subscriptions and credit packs

  • A subscription renews automatically at the end of each period at the price shown when you subscribed, until you cancel
  • Cancel at any time: in the App Store or Google Play subscription settings if you subscribed there, or in Settings → Subscription in this app if you paid on the web. Cancelling stops the next renewal; you keep access until the end of the period you paid for
  • Subscription credits are an allowance for each period. They are refilled at each renewal, do not carry over, and end when the subscription ends
  • Credits from a credit pack do not expire
  • Prices are shown before you pay. We give at least 30 days' notice of a price change for an existing subscription

6.2 Refunds

Refunds are handled under our Refund Policy.

7. Service Availability

7.1 Uptime

  • We work to keep the service available, but we do not guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance when possible

7.2 Modifications

  • We reserve the right to modify or discontinue features
  • Major changes will be communicated with reasonable notice

8. Privacy and Data Protection

Your use of our Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

9. Intellectual Property

9.1 Service Content

  • All Service features, functionality, and content are owned by us
  • You may not copy, modify, or reverse engineer any part of the Service

9.2 Feedback

  • Any feedback you provide may be used by us without compensation
  • You grant us full rights to use and implement suggestions

10. AI-Generated Content Disclosure and User Responsibility

10.1 AI Content Nature and Disclosure

Important Notice: All Content is AI-Generated

  • Characters you chat with are AI, not people
  • ALL images, characters, and visual content on this platform are created using artificial intelligence
  • Content is created for entertainment, artistic, and commercial purposes only
  • Users acknowledge that AI-generated content may not represent reality

Content Authenticity:

  • AI-generated images may appear photorealistic but are entirely synthetic
  • Characters and personas are fictional creations, not real individuals
  • Generated content is synthetic even when it looks photorealistic. It is not a record of real people or events
  • If you publish AI-generated images or videos that resemble real people, places, or events, label them as AI-generated
  • Users should not misrepresent AI content as depicting real people or events

10.2 User Content Responsibility

USERS ARE SOLELY AND COMPLETELY RESPONSIBLE FOR:

  • All content they generate using the Service
  • Ensuring generated content complies with ALL applicable laws and regulations
  • Any consequences arising from the use, distribution, or display of generated content
  • Determining the appropriateness, legality, and ethical implications of content for their intended use
  • Properly disclosing AI-generated nature of content where legally required

Prohibited content. You may not create, upload, or share:

  • Sexual content of any kind involving a minor, including fictional characters presented as under 18
  • Sexually explicit content (not available in this app)
  • A real person's name, photo, likeness, or voice without their permission
  • Non-consensual intimate imagery
  • Harassment, hate, threats, or content encouraging self-harm
  • Deceptive deepfakes, fraud, or anything illegal

You may also not circumvent the platform's safety features or use the Service to infringe intellectual property rights.

10.3 AI Tool Nature and Limitations

This Service provides AI-powered tools for content generation. Users acknowledge that:

  • The Service is a technology tool that responds to user inputs
  • AI-generated content is unpredictable and may contain errors, biases, or inappropriate elements
  • Users must independently verify the appropriateness, quality, and legality of all generated content
  • AI models are provided "as-is" without warranties regarding output quality or suitability

No Guarantees:

  • No guarantee of consistent quality, style, or appropriateness
  • No guarantee that safety filters will catch all inappropriate content
  • No guarantee of legal compliance in any jurisdiction
  • No guarantee regarding intellectual property clearance

10.4 Service Liability Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE SHALL NOT BE LIABLE FOR:

  • Any user-generated content or its consequences
  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenues, or data
  • Any damages arising from the nature, quality, or inappropriateness of generated content
  • Any legal issues arising from user's use, distribution, or display of generated content
  • Any harm caused by deepfakes or misuse of AI-generated content
  • Any violations of laws, regulations, or rights resulting from generated content

10.5 Reporting

Use the Report button on a generated image or a chat message to report content that is offensive, sexual, violent, or otherwise breaks these Terms. You can also email support@ashweb.io. To report a character that uses your name, photo, or likeness without permission, email support@ashweb.io.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Service and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

12.1 Termination by You

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period

12.2 Termination by Us

  • We may terminate or suspend your account for Terms violations
  • We may terminate with 30 days notice for any reason

13. Governing Law

These Terms are governed by the laws of the place where AshWeb Inc. is established. This does not take away protections the law of your country of residence gives you as a consumer.

14. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date.

16. Entire Agreement

These Terms, together with the Platform Terms, the Privacy Policy, and the Refund Policy, are the entire agreement between you and AshWeb Inc. regarding the Service, superseding any prior agreements.
